Terms of Use

1. Acceptance of Terms

By downloading, installing, purchasing through, or using English TestLab - TOEIC® Test (“English TestLab” or the “App”), you agree to these Terms of Use. If you do not agree, do not use the App. If you use the App on behalf of a minor, you confirm that you are authorized to accept these Terms for them.

2. Description of the App

English TestLab is an educational app for TOEIC Listening and Reading practice. The App may provide:

  • Practice questions and simulated exams
  • Local progress, performance, weak-point, and study-plan features
  • Optional AI explanations and AI Coach features that require opt-in
  • Free usage allowances and optional Premium features
  • English and Thai interfaces

Features, free allowances, question banks, supported platforms, and availability may change as the App develops. We will not reduce rights already granted by a completed purchase except where required for security, legal compliance, third-party platform requirements, or discontinuation of the App or a dependent online service.

3. Educational Purpose and TOEIC Disclaimer

The App is provided for education and practice only. It does not provide an official TOEIC score, guarantee any examination result, or replace information from an official testing organization.

TOEIC® and TOEIC Bridge® are registered trademarks of Educational Testing Service (ETS). English TestLab is not affiliated with, endorsed by, or approved by ETS or an official TOEIC testing organization. Practice content is independently created or lawfully licensed and is not copied from an actual TOEIC examination.

4. Data and Privacy

The App does not require an account, name, email address, or custom User ID. Most learning history, preferences, and saved AI outputs remain on your device. The App also uses limited analytics, purchase, attribution, technical, and opted-in AI-processing data as explained in our Privacy Policy.

AI requests pass through the English TestLab Firebase gateway and may be processed by an AI provider or our n8n fallback service, depending on service configuration and availability. You can revoke AI permission in the App under Settings > AI & Privacy.

5. Premium Lifetime Purchase

English TestLab Premium is currently offered on iOS as a one-time, non-consumable in-app purchase. It is not an auto-renewing subscription and does not charge a recurring fee.

  • The price and currency displayed in the App are supplied by the App Store and may vary by country, region, tax, and Apple pricing rules.
  • Payment is processed by Apple and charged to the Apple Account used to complete the purchase.
  • A completed purchase unlocks the Premium entitlement included in the offer shown at the time of purchase.
  • You can use Restore Purchases with the Apple Account that made the purchase. Restore is subject to a valid App Store receipt and Apple’s purchase systems.
  • Refund requests and eligibility are handled by Apple under the Apple Media Services Terms and applicable consumer law.

6. Meaning of “Lifetime”

“Lifetime” means that the Premium entitlement is non-expiring and has no recurring subscription fee. It applies to English TestLab and the Premium features included with the purchased product. It does not mean the lifetime of an individual user, guarantee that every future product or separately priced feature will be included, or guarantee that the App or an online dependency will operate forever.

We may improve, replace, or discontinue features for technical, security, legal, or operational reasons. Where reasonably possible, we will avoid materially removing the core value of a valid Premium entitlement without providing an appropriate alternative, subject to applicable law.

7. Legacy Paid-App Eligibility

Some users who purchased an earlier paid version of English TestLab may be eligible for grandfathered Premium access. Eligibility is determined from available App Store receipt information and the App’s migration rules. If eligibility cannot be confirmed automatically, contact support with non-sensitive purchase information that can help us investigate. Do not send payment-card details.

8. AI Features

AI-generated explanations, summaries, weak-point analyses, and study plans may be incomplete, inaccurate, or unsuitable for your circumstances. You should verify important information independently. AI output is educational assistance only and is not professional, legal, medical, financial, or official examination advice.

AI features depend on network access and third-party infrastructure and may be delayed, rate-limited, unavailable, or changed. “Unlimited” AI access, where displayed as a Premium benefit, means no ordinary per-question allowance imposed by the App; reasonable technical, safety, abuse-prevention, and service-availability limits may still apply.

Do not intentionally submit personal, confidential, unlawful, or third-party-protected information through AI features. You remain responsible for how you use AI output.

9. Acceptable Use

You agree to use the App only for lawful, personal educational purposes. You must not:

  • Use the App or its content commercially without written authorization
  • Copy, publish, sell, sublicense, scrape, or redistribute the question bank
  • Reverse engineer, decompile, disassemble, or attempt to discover non-public source code, except where applicable law expressly permits it
  • Circumvent Premium access, quotas, purchase validation, or security controls
  • Use bots, scripts, automation, or excessive requests to abuse AI or other online services
  • Interfere with the App, servers, providers, or another user’s access
  • Use the App in a way that violates law or another person’s rights

10. Intellectual Property

The App, its original question content, software, design, branding, and other materials are owned by or licensed to English TestLab and are protected by applicable intellectual property laws. Third-party names, trademarks, libraries, and materials remain the property of their respective owners.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the App for non-commercial educational purposes.

If you voluntarily provide feedback or suggestions, you grant us permission to use them to evaluate and improve English TestLab without payment or obligation to implement them.

11. Third-Party Services

The App relies on third-party services for App Store distribution and payments, purchases and entitlements, analytics, attribution, infrastructure, and AI processing. Those services may have separate terms and privacy practices. We are not responsible for a third-party service outside our reasonable control, but this does not limit any responsibility that cannot lawfully be excluded.

12. Availability, Updates, and Changes

We may release updates, security fixes, content changes, or new versions. Some online or AI features may require a supported App version, compatible device, and internet connection. We do not guarantee uninterrupted or error-free availability.

We may update these Terms when the App, law, or service relationships change. We will update the “Last updated” date and, when reasonably appropriate, provide additional notice in the App or on our website. Your continued use after revised Terms take effect means you accept them, to the extent permitted by applicable law.

13. Suspension and Discontinuation

We may restrict access to online or AI services when reasonably necessary to address abuse, security risks, legal requirements, provider restrictions, or material violations of these Terms. Because the App does not use an English TestLab account, a valid Premium entitlement is normally determined through the App Store receipt and RevenueCat rather than a user profile that we can independently terminate.

We may discontinue the App or an online dependency. Any suspension or discontinuation remains subject to rights that cannot be excluded under applicable consumer law and to Apple’s rules for App Store purchases.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ITS CONTENT, AI OUTPUTS, AND ONLINE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM WARRANTIES THAT MAY LAWFULLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION.

Nothing in these Terms excludes a warranty, guarantee, or consumer right that cannot be excluded or limited under applicable law.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENGLISH TESTLAB WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS OR DATA; INABILITY TO USE THE APP; RELIANCE ON AI OUTPUT; OR TEST-PERFORMANCE OUTCOMES.

These limitations do not apply where liability cannot lawfully be excluded or limited, including mandatory consumer protections.

16. Age and Parental Review

The App is intended for a general audience and is not directed to children under 13. If you are under the age at which you can enter into a binding agreement where you live, your parent or legal guardian should review these Terms and supervise your use of the App and any purchase.

17. Governing Law

These Terms are governed by the laws of Thailand, without regard to conflict-of-law principles. This choice of law does not deprive you of mandatory consumer protections or rights available under the law that applies where you live.

18. General Terms

If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and applicable Apple terms, form the agreement governing your use of the App.
