1. Acceptance of Terms

By downloading, installing, or using English TestLab (“the App”), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Description of Service

English TestLab is a mobile application designed to help users practice for the TOEIC (Test of English for International Communication) examination. The App provides:

• Practice questions for TOEIC exam preparation
• Simulated exam environments
• Performance tracking and statistics
• Optional AI-powered explanations and coaching features (opt-in)
• Optional Premium subscription features (in-app purchase)
• Multiple language interface support (English and Thai)

3. Educational Purpose

The App is provided for educational and practice purposes only. English TestLab is not affiliated with, endorsed by, or officially connected with Educational Testing Service (ETS) or any official TOEIC testing organization. The practice questions are independently created and do not represent actual TOEIC exam questions.

4. User Accounts and Data

4.1 Local Data Storage: The App stores user data locally on your device, including:

• Exam session history
• Performance statistics
• User preferences and settings
• Progress tracking information

4.2 Privacy: The App does not require you to create an account, and most learning data remains on your device. If you opt in to AI features, certain learning content and performance data may be transmitted to our server/webhook service and to a third-party AI provider (OpenAI) to generate AI outputs. 5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App for any commercial purpose without authorization
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices from the App
• Use the App in any way that violates applicable laws or regulations
• Share or redistribute App content without permission

6. Intellectual Property Rights

6.1 App Ownership: The App, including all content, features, functionality, and user interface, is owned by English TestLab and is protected by international copyright, trademark, and other intellectual property laws.

6.2 Limited License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

6.3 User-Generated Content: Any feedback, suggestions, or ideas you provide about the App may be used by us without obligation or compensation to you.

7. Disclaimer of Warranties

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy, reliability, or completeness of content
• Fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free operation

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENGLISH TESTLAB SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or other intangible losses
• Damages resulting from your use or inability to use the App
• Test performance outcomes or exam results

9. Updates and Modifications

9.1 App Updates: We may release updates, patches, or new versions of the App. You may need to update the App to continue using it.

9.2 Terms Updates: We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

10. Third-Party Services

The App may contain links to or integrate with third-party services. We are not responsible for the content, privacy policies, or practices of any third-party services.

11. Geographic Restrictions

The App is available globally, but we make no representation that the App is appropriate or available for use in all locations. Users accessing the App from jurisdictions where its contents are illegal or restricted are responsible for compliance with local laws.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, including for violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and English TestLab regarding the use of the App and supersede all prior agreements and understandings.

16. No Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

You agree to comply with all applicable export and re-export control laws and regulations in your use of the App.

BY USING ENGLISH TESTLAB, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM.
